DAS, Airbnb and Circulation economy

Rovaniemi is a city of students and tourists. Traveling to Lapland is on a global rise and the amount of people staying over in Rovaniemi has surged in recent years. Some newspapers are even claiming a shortage on accommodation. At the same time, short-term accommodation services such as Airbnb have gained popularity. Services that are based on circulation economy in which people share spaces, services and items that are temporarily unnecessary to them for a small compensation are a part of today, and surely our future.


From time to time, we have received questions about if it is possible to rent out our apartments through these kinds of accommodation websites. We have also received complaints about short-term visitors, and sometimes the fees asked for our apartments online seem reasonably high. So, please consider that organizing any kinds of accommodation services in DAS apartments is forbidden. Based on the Finnish Act on Residential Leases, you are allowed to sublease your apartment completely or only partially (notice that you cannot sublease a part of your room in a shared apartment or studio), but in both cases you must inform DAS about the subleasing beforehand. Our regulations and the legislation that governs the foundation itself forbid you from making a profit through subleasing. Also, consider the fact that subleasing the whole apartment between 1.9. and 30.4. requires that the subtenant is also a student.


The terms of our tenancy agreement refer to accommodating other people in the apartment, for example, in the following points: 1, 2, 6, 7 and 8. Our order regulations mention the same topic in points 8 and 23. The Act on Residential Leases, 61§ point 3, states that the lessor has the right to rescind the tenancy agreement if the apartment is used for other purposes or in other ways than has been intended when making the tenancy agreement.


As a summary, DAS apartments are only handed out to the student mentioned in the tenancy agreement for a place to live in. The apartment cannot be given to anyone else to use without permission and the tenant cannot use the rental apartment specifically meant for living for business. Breaking the terms of our tenancy agreement and current legislation are a basis for rescinding the tenant’s tenancy agreement if necessary. DAS regularly observes the selection of different accommodation services and takes actions, if necessary, in case the foundation notices that its apartments are being used for business.


We understand that the urge to organize accommodation in the apartment when the tenant might not need the apartment for himself or herself can be big. However, we would like to stress that the apartment has been handed over specifically to you for you to live in and the apartment is not meant to be used for accommodation business. Guests and subtenants are warmly welcomed to Rovaniemi and we hope they will enjoy their stay over at your place, but even they are expected to follow our regulations.
